Alarm South
East Insurance Day 27th January 2010
Alarm South East held a well attended
Insurance Day in London on 27th January with the kind assistance of
RMP, DWF, Claim Experts and Chartis.
The first half of the day involved
an interactive session with a team from DWF LLB - John
Morrell, Mark Whittaker, Perry Hill and Katrina Boyd - on
"Child's Play": the wide variety of claims that can arise
where children are involved. Delegates split into Teams to work
through a variety of claims scenarios and then put forward
decisions on how much to offer as settlement to avoid Court or
whether to defend. Perry and John then explained the
relevant current law and the likely reaction from a judge or
claimant solicitors to the offers from the Teams. Teams
were judged and ranked on how much money they spent in
settling/defending the claims. Feedback forms showed that for many
delegates, this was a very well received session.
The afternoon opened with Richard Hanson-James
of Claim Experts speaking on "Claims Handling in a Hardening
Market" which involved a structured look at the claims process from
the insured's perspective offering very useful tips and guidance on
how to ensure the claim can be most efficiently dealt with.
The insurance and risk management arrangements
pertaining to Fine Art were discussed by Pam Savill of RMP and
Sophy Grindell of Chartis. This session raised a very number
of questions from delegates demonstrating the subject matter was
relevant as well as interesting.
The final session was an update aimed at those
members with responsibility for claims arising from tree roots on
the work of the Alarm South East Tree Root Forum. This was
delivered by Peter Osborne of Treesubs with assistance from Nick
Bathurst and David Abraham from Barlow Lyde and Gilbert LLB and the
session proved to be a very useful forum for ideas and
debate.

Alarm South East Tree Root
Forum, 23rd September 2009
The Alarm South East region held its
inaugural Tree Root Forum at the
offices of London Borough of Camden on 23rd
September 2009. The Forum was
generated by the interest shown by many
South East colleagues who retain
insurance responsibilities in their role
and who have encountered increasing
costs when dealing with claims alleging
tree root nuisance by local
authority owned trees.
24 local authority representatives attended
along with brokers and
solicitors who added their valuable input
as the afternoon progressed.
Peter Osborne of Treesubs and Andrea
Plucknett of Welwyn Hatfield Borough
Council put together a presentation
explaining the large adverse impact on
local authority budgets and the possibility
of a combined, co-ordinated
approach by Alarm members to effect change.
Jim Smith of the Forestry
Commission and London Tree & Woodland
Framework spoke on the Joint
Mitigation Protocol process and the
progress on same. (It is intended to
make Jim's slides also available via the
Alarm website.)
Members then broke into groups to address
the points listed on the final
slide of Peter and Andrea's presentation
with the result that next steps
planned for mid-Novembera take the form of
an inter-authority working group
which Peter has kindly agreed to
co-ordinate. This will cover discussion of
raising publicity, joint funding of cases
and improving dialogue between the
relevant parties.
It was also proposed by delegates that a
map depicting costs and claims
would be a useful representation of cross
local authority experience.
Jim kindly agreed to follow this up,
probably initially on a London-wide
basis.

Keith Vincent from the Law Commission made a presentation on the
topic of Public Sector Liability Reform entitled
Administrative Redress: Public Bodies and the Citizen.
Risks Arising from the Credit Crunch
David Webb from PriceWaterhouseCoopers presented a paper
entitled The Credit
Crunch: Risks to the Public Sector which focused on the risks
facing public sector organisations from reliance on private
sector delivery of services and projects.
Legal Review of 2008
Simon Johnson from Watmores Solicitors reviewed topics including
Highways, Social Services and the Supervision of Children.
