Guidance on Corporate
Manslaughter
Following the issue in November 2005 of
guidance on Alternative Risk Financing (ARF), we have now published
the next research document to be provided under our contract with
the Cullen Centre at Glasgow Caledonian University, providing
guidance on the subject of Corporate Manslaughter. The document is
being issued to all of our members in response to widespread
concern that the current law was not delivering justice, giving
rise to the publication by the Government in March 2005 of a draft
Corporate Manslaughter Bill for England and Wales.

Human Rights Act Guidance
Paper
The purpose of this document is to provide you
with a practical guide to the implications of the Human Rights Act
1998 which has been incorporated into English law on 2nd October
2000. It is one of the most significant pieces of legislation
to be enacted in this country as it incorporates the European
Convention on Human Rights into UK law and will therefore have a
profound effect on the decision-making of all public bodies.
Our employers are the primary decision-makers in a range of fields
in which the Act confers important new rights on individuals and
all of us who work in the Public Sector will therefore be faced
with new and challenging responsibilities. The Act applies to all
public authorities and this includes local authorities, government
departments, police and fire authorities, the courts
themselves. NHS Trusts, the armed forces and many other
public bodies which carry out functions of a public
nature. It is not just individual services which need
to consider the human rights aspects of their work. The whole
of the organisation, including the corporate and strategic centre,
need to be compliant with the Act and decisions made at all levels
and all policy and procedural documents have to be formulated with
an eye on the rights afforded to the public with whom we deal in
our day to day work.
