Alarm Needs Your Comments:
Help Stop Disproportionate Claimant Costs
You will be aware
Alarm has been involved in responding to the Government's
consultation document 'Solving Disputes in the County Courts'. As
part of the ongoing work we have been approached by Jonathan
Djanogly, Parliamentary Under- Secretary of State for Justice for
further comments on the specific topic of extending the existing
RTA PI Protocol to cover claims up to the value of £25,000 and to
include employers' and public liability accident
claims.
Alarm has a working group looking at this and from the work done
previously it has been identified that data will help to support
our arguments. Accordingly a template for claims data has
been drawn up and I would ask as many of you as possible to
complete
and return the template for your authority. All
data submitted will be recorded against the type of organisation
and will not be linked to your own organisation to ensure
confidentiality.
The data is to record the number of injury claims where claimants
have representation (i.e not claimants in person) detailing any
payments made split between payment to the claimant and payment to
the claimant's representative. It is hoped that the data will
support that fixed costs in the proposal should be extended and
also that timescales must be increased to prevent claims falling
out of the portal and resulting in disproportionate costs that we
have now continuing.

will give us time to review the data and compile a response.
